4. Travel conditions, outdoor activities and personal responsibility

Lake Tahoe and the Sierra Nevada can involve rapidly changing weather, snow, ice, wildfire, smoke, altitude, cold water, traffic, road closures, wildlife and outdoor hazards. Information on weather, roads, trails, beaches, campgrounds, ski areas, boating, transportation or events may be delayed, incomplete or outdated.

• Check official government, land-manager, transportation and emergency sources before traveling.
• Follow posted rules, closures, permit requirements, fire restrictions and safety instructions.
• Use appropriate equipment, preparation and judgment for outdoor activities.
• Do not rely on Everything Tahoe for emergency communications or real-time warnings.

5. Third-party businesses, links and transactions

The website contains links to and information about hotels, vacation rentals, restaurants, casinos, campgrounds, activity providers, transportation services, government agencies, reservation systems and other third parties. Everything Tahoe generally does not own, operate or control those third parties.

Unless expressly stated otherwise, Everything Tahoe is not a party to reservations, purchases, rentals, tours, transportation, contracts or other transactions between you and a third party. Availability, pricing, taxes, fees, cancellation terms, safety, accessibility and service quality are controlled by the third party.

Your use of a third-party website or service is governed by its own terms and privacy policy. A link, listing or map marker does not by itself constitute an endorsement.

6. Accounts and registration

Some features may require an account. You agree to provide accurate information, keep login credentials confidential and notify us promptly of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law.

When you submit content for publication, you grant Everything Tahoe a nonexclusive, worldwide, royalty-free, sublicensable and transferable license to host, store, reproduce, format, adapt for display, publish, translate, distribute and promote that content in connection with operating and marketing the website and its services. This license allows us, for example, to resize a submitted photograph, display a review on a business page or quote a review in a category guide.

You also allow us to use the profile name or attribution you provide in connection with the submission. This license continues for content already used or shared, subject to applicable law and our ability to remove content from systems and backups.

Moderation

We may review, reject, edit for formatting, restrict, move or remove user content at our discretion, but we are not obligated to monitor every submission. Publication does not mean Everything Tahoe agrees with or verifies the content. Reviews represent the opinions of their authors.

Businesses may be allowed to respond to reviews. A response must comply with the same content standards and may not expose private customer information.

• Interfere with website security, performance, access controls, robots instructions or other users.
• Use automated systems to submit content, spam forms or overload the website.
• Use Everything Tahoe content, branding or data to misrepresent affiliation or endorsement.

9. Business listings, advertising and affiliate relationships

Business listings may be created from public information, submissions, editorial research or business-owner requests. A listing does not guarantee accuracy, endorsement, customer leads, traffic or continued placement. Businesses should report material errors through our contact or correction process.

Everything Tahoe may offer claimed profiles, featured placements, advertising, sponsorships or other promotional services. Paid or sponsored relationships may be labeled where required. Payment for advertising does not entitle a business to positive reviews, removal of legitimate criticism or a particular editorial ranking.

Some links may be affiliate links. If Everything Tahoe may receive compensation from a qualifying transaction, we will provide an appropriate disclosure. Unless expressly stated, the price paid by the visitor is determined by the third party.

10. Everything Tahoe intellectual property

The website’s original text, layout, branding, graphics, interactive tools, compilations, databases, code and other materials are owned by Everything Tahoe or used with permission and are protected by intellectual-property laws.

You may view and use the website for personal, noncommercial travel planning. You may share links to public pages and quote short excerpts with clear attribution. You may not reproduce, republish, sell, license, remove attribution from, create a competing database from or commercially exploit substantial website content without written permission.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EVERYTHING TAHOE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the website will be uninterrupted, secure or error-free; that content will always be current; that a business or activity will meet your expectations; or that user submissions are accurate. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYTHING TAHOE AND ITS OWNERS, CONTRIBUTORS, CONTRACTORS AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE OR OTHER LOSSES ARISING FROM OR RELATED TO THE WEBSITE, THIRD-PARTY SERVICES, TRAVEL DECISIONS OR USER CONTENT.

To the extent liability cannot be excluded, Everything Tahoe’s aggregate liability for claims relating to the website will not exceed the greater of the amount you paid directly to Everything Tahoe for the relevant service during the preceding 12 months or 100 U.S. dollars, except where a different limitation is required by law.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Everything Tahoe and its owners, contributors, contractors and affiliates from claims, losses, liabilities and reasonable costs arising from your user content, misuse of the website, violation of these terms or infringement of another person’s rights.

16. California law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes arising from these terms or the website will be brought in a state or federal court of competent jurisdiction in California.

Before filing a claim, you agree to send a written description of the dispute to the contact address below and allow 30 days for an informal attempt to resolve it. Nothing in this section prevents either party from seeking urgent injunctive relief when appropriate.
